XSparks provides AI agent development, integration, and operational services. Services are provided on an 'as-is' basis subject to the terms herein.

To use certain services, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate information.

You agree not to: use services for illegal purposes, attempt to gain unauthorized access, disrupt service availability, transmit malware, infringe intellectual property rights, or misuse our agents or infrastructure.

You are responsible for: maintaining security of your data and systems, backing up your data, complying with applicable laws, and ensuring your use of our services complies with these terms.
06 · Intellectual Property Rights
We retain all rights to our software, methodologies, and documentation. You retain ownership of data and content you provide. You grant us a license to use your data to provide services and improve our offerings.
07 · Data & Privacy
Our handling of your data is governed by our Privacy Policy. You are responsible for ensuring you have necessary rights to provide data to us and that our processing complies with applicable laws.
08 · Third-Party Integrations
Our services may integrate with third-party APIs and services. We are not responsible for third-party service availability, security, or performance. Review third-party terms before integration.
09 · AI-Generated Content
Content generated by our AI agents is provided for your use subject to these terms. You are responsible for reviewing and validating AI-generated output. XSparks does not warrant accuracy of AI-generated content.
10 · Warranties & Disclaimers
Services are provided 'as-is' without warranties of any kind. We do not warrant that services will be uninterrupted, error-free, or meet your specific requirements. Some jurisdictions do not allow limitation of implied warranties.
11 · Limitation of Liability
To the extent permitted by law, XSparks shall not be liable for indirect, incidental, special, consequential, or punitive damages. Total liability shall not exceed fees paid in the past 12 months.
12 · Termination
Either party may terminate services with written notice. Upon termination, your right to use services ceases immediately. We will return or delete your data as specified in our Data Processing Agreement.
13 · Policy Changes
We may modify these terms. Changes are effective when posted. Continued use of services constitutes acceptance of modified terms.
14 · Governing Law
These terms are governed by the laws of the jurisdiction in which XSparks is incorporated. You agree to submit to the exclusive jurisdiction of courts in that location.
